申請取次制度は、申請人、外国人受入れ企業等の申請者サイド
及び入国管理局サイドの双方にとってメリットがあります。

入国管理における申請取次制度
わが国に在留する外国人は、在留資格の変更、在留期間の更新等の各種申請を行おうとする場合、原則として、自ら地方入国管理局等に出頭して、申請書類を提出しなければならないこととされています。
これは、申請する外国人の同一人性と申請意思を確認するため、また、申請内容に関連して不明な点があれば質問したり、不備な点の補正を指示したりするため、更に、申請の結果を申請人本人に確実に伝えるために申請人の出頭が必要であるとの考えに基づくものです。
行政書士が申請人に代わって申請書等を提出できます。
申請取次制度は、上記の目的が他の方法で充たされる場合に本人出頭の原則を免除しようとするものです。具体的には、行政書士が申請人に代わって申請書等を提出することが認められるというものです。この制度は出入国管理業務の知識等を有し、申請取次者として承認された者により手続きが行われることから、申請人、外国人受入れ企業等の申請者サイド及び入国管理局サイドの双方にとって、次のようなメリットがあります。
- 申請人本人は、入国管理局への出頭が免除されるので、仕事や学業に専念できる。
- 外国人を雇用する企業、留学生を受け入れている学校、旅行業者等においては、行政書士によって的確・迅速に雇用や受け入れ等の手続きを進めることができる。
- 入国管理当局にとっては、必要書類の完備や一括申請が図られることにより審査事務処理の円滑化を推進することができる。
